Number 306 - Residential and Subdivision Policy Review

The draft variation was prepared to implement a review of the ACT residential and subdivision policies.
Broad policy changes are proposed to relevant codes, which include:
- improvements to solar access and protecting suburban character
- improvements to solar access for homes
- protection of amenity within the residential RZ2 suburban core zone
- changes to subdivision provisions for new estates
The draft variation proposes:
- changes to residential development, estate development and leasing codes
- replacement of residential zones objectives development tables, and housing development codes
- introduction of Residential Zones Development Code and Lease Variation General Code
- replacement of existing Residential Subdivision Development Code with an Estate Development Code

Withdrawal of draft variations 301 and 303![]()
Draft variation 306 supersedes 301 and 303 which have been withdrawn.
Comments made regarding 301 and 303 have been considered in the preparation of 306 along with recommendations of the Territory Plan Code Reference Group which was formed by direction of the former Minister for Planning.

Removal of specified restrictions on use at Turner section 47 and part 63, and North of Macarthur and Wakefield Avenue (RZ4 Medium Density Residential Zone)

The draft variation does not have interim effect and therefore section 65 of the Planning and Development Act 2007 does not apply. The current Territory Plan will continue to apply while the variation remains in draft form.

Griffith section 42 block 15: change of zoning from commercial CZ6 leisure and accommodation zone to RZ4 medium density residential zone to allow for medium density housing up to 3 storeys in height.

Number 300 - Gungahlin Town Centre
Gungahlin Town Centre: zoning changes, revisions to Structure Plans for Gungahlin, introduction of a Precinct Code and resultant amendments to the Territory Plan.

The draft variation has interim effect under section 65 of the Planning and Development Act 2007 for a period of up to one year from Tuesday 30 November 2010. During this period, the Territory, the Executive, a Minister or a territory authority must not do or approve the doing of anything that would be inconsistent with the Territory Plan if it were varied in accordance with the draft plan variation.
