Draft variations to the Territory Plan

Omnibus Draft Territory Plan Variation

The ACT Government is preparing an ‘Omnibus’ Draft Territory Plan Variation that will propose changing zoning and development opportunities for approximately 17 sites across Canberra, including several public housing sites. These planning changes will pave the way for appropriate redevelopment in the future.

The omnibus draft variation supports the Government’s land release program and the revitalisation of the public housing portfolio consistent with the Public Housing Asset Management Strategy 2012–2017. It also builds on the ACT Planning Strategy, which aims to create a more compact and efficient city that offers employment opportunities, which is an important part of the ACT Government’s initiatives to stimulate the ACT economy.

Rather than issue individual draft variations for each site, the draft variations are being combined into an omnibus variation. This will allow the community to gain an appreciation of the overall issues that underpin the variation.

Planning studies into the sites have commenced. The public housing tenants at the relevant sites have been advised about the upcoming draft variation and engagement with stakeholders and community councils has commenced, including briefings.

These briefings and meetings inform councils and the community of the omnibus draft variation process and gain information that will help inform how the sites might be developed. They will assist in formulating the actual Territory Plan amendment proposals before they are released for formal community consultation, expected in September.

The draft variation will go through the usual Territory Plan amendment process, with the Legislative Assembly making the ultimate decision on each site. No development will occur on a site until the onmibus variation is finalised and subsequent development applications approved.

DV319 - Zone and Overlay changes to Public Land in the Gungahlin District

Draft Variation to the Territory Plan Number 319 (DV319) proposes to make changes to public land in the Gungahlin District as a result of the Gungahlin Strategic Assessment Biodiversity Plan. DV319 proposes to:

  • update the East Gungahlin Structure Plan
  • introduce a concept plan for the suburb of Throsby
  • include areas of Throsby as 'nature reserve' in the NUZ3 Hills, Ridges and Buffer Zone
  • include Kinlyside as 'nature reserve' in the NUZ3 Hills, Ridges and Buffer Zone
  • include Horse Park north and parts of Jacka and Taylor in the NUZ3 Hills, Ridges and Buffer Zone

DV319 does not have interim effect.

DV297 - Public Land Overlay and Zone Changes

Draft Variation to the Territory Plan Number 297 (DV297) proposes to make changes to the public land overlay and zone provisions at various locations in Canberra in response to separate requests from the Conservator of Flora and Fauna and Economic Development Directorate. DV297 includes:

  • adding Hackett Horse Holding Paddocks 5 and 6 to the adjacent existing nature reserve;
  • incorporating offset areas into the existing Gungaderra and Mulangarri Nature Reserves in order to offset impacts from the proposed development on block 799 Gungahlin;
  • incorporating part block 2110 Jerrabomberra into the existing Issacs Ridge Nature Reserve to offset the impact of the expansion of the Mugga Lane Resource Management Centre; and
  • remove the public land overlay of 'urban open space' from Yarralumla Nursery

DV297 does not have interim effect.

DV321 Pialligo

DV321 proposes to amend the Pialligo precinct map and code to guide future development within the Pialligo agricultural area.

The amendments to the Pialligo precinct map and code, drawing on the recommendations of the Pialligo master plan released in November 2013, will provide clear direction on the future desired character of the area while protecting the semi-rural character of the area, and ensuring the potential for agricultural uses are retained.

Effect of the draft variation

Section 65 of the Act applies to the draft variation. This means that, in addition to the Territory Plan, the provisions of Draft Variation 321 apply to development applications lodged on or after 2 May 2014. The draft variation is part of the Territory Plan for a period of up to one year unless the draft variation is commenced, is withdrawn or rejected by the Legislative Assembly. During this period, the ACT Government must not do or approve anything that would be inconsistent with the Territory Plan. 

DV320 Erindale Group Centre and surrounding community and recreation lands

DV320 proposes to amend the requirements for development in the Erindale Group Centre, and parts of the surrounding community facility and recreation lands, in the Wanniassa precinct map and code.

The changes are drawn from the recommendations of the Erindale Group Centre master plan and will guide future development through rezoning of a number of areas within the centre, increasing maximum permitted building heights on selected sites, and amending road layouts and pedestrian routes.

The proposed changes are intended to promote Erindale centre as a thriving business and community hub, with employment opportunities, facilities and services for the surrounding population catchment while improving vehicle and pedestrian access through the centre.

DSV S323 Mental Health Facility Symonston

Three submissions were received during the consultation period:

The need for a secure mental health facility in the ACT has been identified for people who require short-to medium term treatment and placement in a secure mental health facility. The development of the facility is an ACT Government priority and is part of stage one of the ACT Government’s Health Infrastructure Program. 

A new type of variation to the Territory Plan has been introduced by changes to the Planning and Development 2007 (the Act). This new type of variation is called a special variation and can only be used to make changes to the Territory Plan to facilitate a mental health facility at Symonston part blocks 11 and 14, section 49. This new process represents a fast-tracking of the Symonston mental health facility through the planning system, while still allowing important community consultation processes to take place.

DV309 Turner Bus Layover

Draft Variation to the Territory Plan Number 309 (DV309) closed for comment on COB 28 May 2014.

DV309 allows for the development of a bus layover on part Block 8 Section 25 Turner by proposing to:

  • rezone the subject site from PRZ1 Urban Open Space Zone to TSZ1 Transport Zone to allow a Public Transport Facility to be developed;
  • remove the Public Land (Pe - urban open space) Overlay from the subject site;
  • clarify the definition of Public Transport Facility to include 'bus layover' and 'driver amenities'.
