Change of use charge

Change of use charge payments

For the purpose of this information, "lease" means Crown lease.

You may be required to pay a change of use charge when you change a lease provision and that change increases the value of the lease. In general, the change of use charge is assessed at 75 per cent of the "added value".

Why a charge is required

When your lease is first granted, the Territory is paid an amount that is based on the rights the lease contains at that time. If you vary your lease in such a way that its value increases, a change of use charge based on that added value is payable. The purpose of the charge is to give back to the community some or all of the added value of your lease that results from the change to your lease.

Pay the charge

Once you have been advised by us that your change of use charge has been determined, you will be informed of the amount and the time within which the change of use charge is payable. You must pay the change of use charge within the requisite time before we are able to proceed with the preparation of the requisite documents to vary your lease.

If you do not agree with the Authority's assessment of the change of use charge, you may within 28 days of the date of the determination, lodge an application with the ACT Administrative Appeals Tribunal for a review of the determination.
