Entity referral

A referral entity may be a government department, statutory body or utility that provides advice to assist with assessing development applications.

Entities and circumstances for referral

Schedule 2 of the Planning and Development Regulation prescribes the referral entities and circumstances for referral.

Entity advice before DA lodgement

Liaison with referral entities may be required before lodging a development application depending on whether the application is in the code track, merit track or impact track.

Note: The Tree Protection and Heritage Unit has moved, however the contact numbers remain the same. For more information go to www.tams.act.gov.au or call Canberra Connect on phone: 132281.

Entity advice after DA lodgement

If a development application is referred to an entity, that entity must give advice within 15 working days. If a referral entity does not provide advice within this time, the entity is taken to have given advice that supports the application.

Where the ACT Planning and Land Authority gives an approval that is consistent with the referral entity advice, that advice is binding – the referral entity must act consistently with their advice when issuing subsequent approvals and undertaking compliance or other actions.
