Single dwellings
Exemptions from approval for single dwellings
Exemptions from development and building approval may apply to certain single dwellings provided they comply with relevant provisions of Regulations. Examples include certain erecting of houses and erecting of houses with combined garage, carport, pergola and deck.
Exemptions from development approval
The development does not need development approval if it complies with relevant provisions of the Planning and Development Regulation 2008, Schedule 1. The following is a summary of the provisions and is correct as of the date the web page was last updated - scroll to the bottom of the web page to find this - however the Regulation's Schedule may been updated since then. In summary, the development is exempt provided that the single dwelling:
- is only a single dwelling (does not apply to dual occupancy or other multi-unit);
- another dwelling has not been built on the block;
- complies with the relevant rules in any relevant precinct code of the Territory Plan and the relevant rules in the Residential Zones Single Dwelling House Development Code of the Territory Plan.
See definitions to understand the terms in italics.
Exemptions from building approval
There are no building approval exemptions for the erection of class 1 houses.
See building approval exemptions in relation to class 10 buildings, for example garages, pergolas and carports, which might be attached to a dwelling.
