Technical regulation of utility networks

Technical regulation reform consultation

Possible areas of reform of ACT legislation and the framework of technical regulation of utility networks is being looked at.

Need for reform

There is a need for reform to ensure regulation remains relevant to and effective in the environment in which utilities operate. Regulation must provide confidence to the community that there is adequate serviceability of infrastructure networks and that appropriate investments are being made to maintain public assets.

The Minister for Planning has agreed to the ACT Planning and Land Authority developing proposals for reform that will provide a more effective and transparent framework for technical regulation of utilities. Community views were sought on what areas of regulatory reform they felt were most important.

OBJECTIVES

POSSIBLE AREAS OF REFORM

A simplified, effective and robust regulatory framework
  • Objects and scope for technical regulation under the Utilities Act
  • Streamlining of regulatory framework (e.g. consolidation of key requirements
    in the Act with technical requirements in Regulations)
  • Definition of utility networks and network boundaries
  • Third-party accreditation for work on existing and new infrastructure
Up-to-date technical standards
  • Review/development of updated technical standards
  • Initiation of rules, codes and standards (by the regulator) and the functional hierarchy of these under the Act
  • Use of operational and management plans by utilities
  • Technical performance and compliance reporting requirements
  • Clearance and access rules for utility network protection
Workable regulation
  • Measurable performance indicators for network serviceability
  • Utility procedures and obligations
  • Compliance audits of utilities technical operations
  • Technical Regulator functions and enforcement powers (including technical inspectors)

Consultation process
